Are vaccines required for a green card?

Yes. Under INA Section 212(a)(1)(A)(ii), all applicants for immigrant visas or adjustment of status to lawful permanent resident must demonstrate proof of vaccination against designated communicable diseases. Without this proof, they are deemed inadmissible - meaning no green card. The required vaccines include DTaP/Tdap, Hib, Hepatitis A, Hepatitis B, Influenza (seasonal), MMR, Meningococcal, Pneumococcal, Polio, Rotavirus, and Varicella.

However, the law provides exemption pathways for those with sincerely held religious beliefs or moral convictions opposing vaccination.

What is a vaccine waiver (Form I-601)?

A vaccine waiver is filed using Form I-601 (Application for Waiver of Grounds of Inadmissibility). It includes a detailed sworn statement demonstrating your sincerely held religious beliefs or moral convictions opposing all vaccinations in any form. The waiver is filed with USCIS along with supporting evidence.

What qualifies as a religious or moral conviction?

Your objection must be based on sincerely held religious beliefs or moral convictions opposing all vaccinations. You do not need to belong to any organized religion - a personal belief system (a "religion of one") is sufficient.

However, the objection must be comprehensive (opposing all vaccines, not selective) and sincere (consistently reflected in your lifestyle and history).

Important: Political, scientific, philosophical, or personal-preference objections do not qualify. The distinction matters, and this is exactly why experienced legal counsel is critical.

Do I need to belong to an organized religion?

No. You do not need church membership, affiliation with a denomination, or ties to any organized religion. USCIS recognizes that deeply held moral and ethical beliefs - even if entirely personal - can form the basis of a valid vaccine waiver.

People of all backgrounds have successfully obtained waivers, including Christians, Muslims, Hindus, Jewish, Buddhists, and individuals with non-religious moral convictions.

What if I received vaccines in the past?

Having received vaccines in the past - including childhood vaccinations from your home country - does not automatically disqualify you. USCIS explicitly considers that beliefs evolve and change over time.

How long does the waiver process take?

Processing times vary significantly depending on your immigration pathway:

  • Adjustment of status (domestic): The waiver is adjudicated concurrently with your I-485. Approvals can come in as little as 2 weeks.
  • Consular processing (abroad): The I-601 is filed separately after a finding of inadmissibility at your consulate interview. This can take 12–38+ months.
